These Terms of Service (”Terms”) describe our commitments to you, and your rights and responsibilities when using our services. Please read them carefully and reach out to us if you have any questions.** If you don’t agree to these Terms, don’t use our services.**
If you are a user in countries located in the European Economic Area, Switzerland, or the United Kingdom (“European User”), some special terms may apply to you as stated below and as required by applicable law.
Terms of Service
These Terms govern your access to and use of the software, website, applications, and other products and services we provide through or for MaGNaM (our “Services”).
Please read these Terms carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by all of the Terms and all other operating rules, policies, and procedures that we may publish via the Services from time to time (collectively, the “Agreement”). You also agree that we may automatically change, update, or add on to our Services as stated in the Terms, and the Agreement will apply to any changes.
1. Who’s Who
“You” means any individual or entity using our Services. If you use our Services on behalf of another person or entity, you represent and warrant that you’re authorized to accept the Agreement on that person’s or entity’s behalf, that by using our Services you’re accepting the Agreement on behalf of that person or entity, and that if you, or that person or entity, violates the Agreement, you and that person or entity agree to be responsible to us.
“MaGNaM”, “we”, “us”, and “our” refer to MaGNaM and its operator, Meric Demirors.
2. Your Use of Our Services and Your Account
When using our Services requires an account, you agree to provide us with complete and accurate information and to keep the information current so that we can communicate with you about your account. We may need to send you emails about notable updates (like changes to our Terms of Service or Privacy Policy), or to let you know about legal inquiries or complaints we receive about the ways you use our Services so you can make informed choices in response.
We may limit your access to our Services until we’re able to verify your account information, like your email address.
When you create an account, you agree that we may contact you about your account, security, legal notices, and the operation of the Services. We will not treat account creation as automatic consent to unrelated marketing communications.
You’re solely responsible and liable for your use of our Services and all activity under your account. You’re also fully responsible for using our Services securely and maintaining the security of your account, including keeping your password secure and your devices and apps up to date.
Don’t share or misuse your access credentials. And notify us immediately of any unauthorized uses of your account. If we believe your account has been compromised, we may suspend or disable it.
If you’d like to learn about how we handle the information you provide us, please refer to our Privacy Policy.
3. Minimum Age Requirements
Our Services are not directed to children. You’re not allowed to access or use our Services if you’re under the age of 13 (or 16 in Europe). If you register as a user or otherwise use our Services, you represent that you’re at least 13 (or 16 in Europe). You may use our Services only if you can legally form a binding contract with us. In other words, if you’re under 18 years of age (or the legal age of majority where you live), you can only use our Services under the supervision of a parent or legal guardian who agrees to the Agreement, where required by applicable law.
4. Responsibility of Visitors and Users
We haven’t reviewed, and can’t review, all of the content (like text, photo, video, audio, code, and other materials) posted to or made available through our Services by users or anyone else (”Content”). We’re not responsible for any use or effects of Content or third-party websites. So, for example:
We don’t have any control over third-party websites.
A link to or from one of our Services does not represent or imply that we endorse any third-party website.
We don’t endorse any Content or represent that Content is accurate, useful, or not harmful. Content could be offensive, indecent, or objectionable; include technical inaccuracies, typographical mistakes, or other errors; or violate or infringe the privacy, publicity rights, intellectual property rights, or other proprietary rights of third parties.
You’re fully responsible for the Content you submit or publish through your MaGNaM account, and any harm resulting from that Content. It’s your responsibility to ensure that your Content abides by applicable laws and by the Agreement.
We aren’t responsible for any harm resulting from anyone’s access, use, or downloading of Content, or for any harm resulting from third-party websites. You’re responsible for taking the necessary precautions to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content.
We are not a party to, and will have no responsibility or liability for, any communications, interactions, or disputes between you and another user, except where applicable law provides otherwise.
Please note that additional third-party terms and conditions may apply to Content you access through third-party services.
If you delete Content, we’ll use reasonable efforts to remove it from public view, but you acknowledge that cached versions of the Content, copies made by other users, or references to the Content may not be immediately unavailable.
5. Fees, Payment, and Renewal
Currently there are no payments or fees existing in the MaGNaM ecosystem. When and if paid features are introduced, the applicable pricing, payment terms, and any additional conditions will be presented through our Services before those paid features are used.
6. Feedback
We love hearing from you and are always looking to improve our Services. When you share comments, ideas, or feedback with us, you agree that we’re free to use them without restriction or compensation to you, to the extent permitted by applicable law.
7. General Representation and Warranty
Our mission is to provide a place for creators and readers to publish, discover, and interact with manga and other creative work. We encourage you to express yourself freely, subject to a few requirements. In particular, you represent and warrant that your use of our Services:
Will be in strict accordance with the Agreement;
Will comply with all applicable laws and regulations, including laws regarding online conduct, acceptable content, copyright, intellectual property, privacy, data protection, and consumer protection;
Will not be for any unlawful purposes, to publish illegal content, or in furtherance of illegal activities;
Will not infringe or misappropriate the intellectual property rights of MaGNaM or any third party;
Will not overburden or interfere with our systems or impose an unreasonable or disproportionately large load on our infrastructure;
Will not disclose the personal information of others without a lawful basis or authorization;
Will not be used to send spam or bulk unsolicited messages;
Will not interfere with, disrupt, or attack any service or network;
Will not be used to create, distribute, or enable material that is, facilitates, or operates in conjunction with, malware, spyware, adware, or other malicious programs or code; and
Will not involve reverse engineering, decompiling, disassembling, deciphering, or otherwise attempting to derive the source code for the Services or any related technology that is not open source.
8. Specific Service Terms
a. MaGNaM Profiles, Manga, Portfolios, and Other Content
You retain ownership of Content that you own and that you submit to MaGNaM, subject to the rights you grant in these Terms and to the rights of third parties.
License. You grant MaGNaM a worldwide, royalty-free, non-exclusive license to host, store, reproduce, display, distribute, and otherwise process your Content to the extent reasonably necessary to operate, provide, maintain, promote, and improve the Services. This license does not transfer ownership of your Content to MaGNaM.
Where you choose to publish Content publicly, you understand that the Content may be viewed, accessed, linked to, indexed, or cached by other people and services. You are responsible for ensuring that you have the necessary rights and permissions to submit and publish the Content.
b. Competitions and Submissions
Where MaGNaM offers competitions or similar submission programs, additional rules may apply to the specific competition. Those rules will be made available with the competition and will form part of the Agreement for participants.
By submitting Content to a competition, you remain responsible for ensuring that you have the rights required to submit that Content. Any additional rights, publication permissions, judging rules, prizes, or other conditions applicable to a competition will be described in the relevant competition rules.
c. Virtual Wallet
MaGNaM may display a virtual wallet or similar in-service balance associated with a user profile. At present, this balance is an in-application number and is not connected to an external payment account or payment processor. It does not constitute a bank account, electronic money account, deposit, or other regulated financial product.
If MaGNaM introduces purchases, payments, or other financial functionality in the future, additional terms may apply before such functionality becomes available.
9. Copyright Policy
As we ask others to respect our intellectual property rights, we respect the intellectual property rights of others. If you believe any Content violates your copyright, please send us a notice at [email protected] with enough information for us to identify the work and the allegedly infringing material.
We may remove or restrict access to content where required by applicable law or where we reasonably believe the content violates these Terms or another applicable MaGNaM policy.
10. Intellectual Property
The Agreement doesn’t transfer any MaGNaM or third-party intellectual property to you, and all right, title, and interest in and to such property remains (as between MaGNaM and you) solely with MaGNaM or the applicable third party. MaGNaM trademarks, service marks, graphics, and logos used in connection with our websites or Services are trademarks or registered trademarks of MaGNaM (or MaGNaM’s licensors). Other trademarks, service marks, graphics, and logos used in connection with our Services may be the trademarks of other third parties. Using our Services doesn’t grant you any right or license to reproduce or otherwise use any MaGNaM or third-party trademarks.
11. Third-Party Services
While using the Services, you may interact with services, software, or applications provided by a third party, including services used by MaGNaM to operate authentication, hosting, storage, email delivery, network, or security functions.
If you use a Third-Party Service, you understand and agree that:
Third-Party Services aren’t controlled by MaGNaM, except to the extent that MaGNaM operates its own integrations with them.
Unless otherwise required by applicable law, use of a Third-Party Service may also be subject to the terms and privacy policy of the relevant third party.
Some Third-Party Services may process information about you as described in our Privacy Policy.
12. Changes
We may modify the Terms from time to time, for example, to reflect changes to our Services or for legal, regulatory, or security reasons. If we do this, we’ll provide notice of the changes, such as by posting the amended Terms and updating the “Last Updated” date or, if the changes are material, we may notify you through our Services or other communications. Any changes will apply on a going-forward basis, unless applicable law requires otherwise. By continuing to use our Services after the amended Terms become effective, you agree to be bound by the new Terms, except where applicable law requires a different process.
13. Termination
We may suspend, restrict, or terminate your access to all or any part of our Services if we reasonably believe that you have violated this Agreement, applicable law, or a relevant MaGNaM policy; if necessary to protect the Services or other users; or where otherwise permitted by applicable law.
We may remove or restrict access to Content that we reasonably believe violates these Terms or applicable law. Where required by applicable law, we will provide notices and any available means of review or redress.
You can stop using our Services at any time and may delete your account using the available account tools or by contacting us where necessary.
14. Disclaimers
Our Services are provided “as is.” MaGNaM and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, to the maximum extent allowed by applicable law, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither MaGNaM, nor its suppliers and licensors, makes any warranty that our Services will be error free or that access thereto will be continuous or uninterrupted.
Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot be excluded or limited under applicable law.
15. Jurisdiction and Applicable Law
Except to the extent any applicable law provides otherwise, these Terms and any access to or use of our Services will be governed by the law of Turkey, without prejudice to any mandatory consumer protection or other mandatory rights that apply to you under the law of your country of residence.
Any court jurisdiction clause will apply only to the extent permitted by applicable law. Where mandatory law gives you the right to bring proceedings in your country of residence, those rights are not excluded by these Terms.
16. Limitation of Liability
To the maximum extent permitted by applicable law, MaGNaM and its suppliers, partners, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Services.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for intentional misconduct, fraud, or other liability that applicable law requires us to retain.
17. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless MaGNaM, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against losses, liabilities, demands, damages, costs, claims, and expenses arising out of or related to your unlawful use of our Services, your violation of the Agreement, or Content that you submit in violation of another person’s rights or applicable law.
Nothing in this section requires you to indemnify MaGNaM where such a requirement would be prohibited by applicable law.
18. Data Processing and Privacy
Our processing of personal information is described in our Privacy Policy.
19. Illegal Content and Content Reports
MaGNaM may provide mechanisms for users and other persons to report allegedly illegal content or content that violates these Terms or applicable MaGNaM policies.
Reports should be submitted through [email protected] and should include enough information for us to identify the relevant content and understand the basis of the report.
Where applicable law, including the Digital Services Act, requires a notice-and-action or similar procedure, MaGNaM will process qualifying notices in accordance with the applicable requirements and will provide notices or information about available redress mechanisms where required.
MaGNaM is a platform that allows users to publish and share their own content, including manga, portfolios, and other user-generated material. Users are responsible for ensuring that the content they upload or publish does not violate applicable laws or the rights of others.
If you believe that content available through MaGNaM is illegal, you may report it to us by contacting [email protected]. To help us review the report, please provide the location of the content (such as its URL), a description of why you believe the content is illegal, and any other information that may help us identify and assess the content.
We will review reports concerning potentially illegal content and may remove or restrict access to content where appropriate. We may also take action where content violates these Terms or otherwise creates a significant risk to the MaGNaM service or its users.
Where we remove or restrict access to a user's content, we will, where required by applicable law, provide the affected user with information about the decision and the reasons for the action taken, together with information about available remedies.
Reports and content-moderation decisions may be handled by the MaGNaM operator and may involve manual review.
MaGNaM may remove, restrict, or disable access to content where we reasonably believe that the content is illegal, infringes the rights of another person, violates these Terms, or presents a significant risk to the MaGNaM service or its users. We may also suspend or terminate accounts where necessary to protect the service, its users, or comply with applicable law.
20. Content Moderation
MaGNaM is an independently developed and open-source project. Content moderation is intended to be limited to what is necessary to operate the service, protect users, comply with applicable law, and enforce these Terms.
Where MaGNaM takes action against user content or an account, the action may include removal of content, restricting access to content, suspending an account, or terminating an account, depending on the circumstances.
We may update our content-moderation practices as the service develops and as required by applicable law.
21. Translation
These Terms were originally written in English. We may translate these Terms into other languages. If there is a conflict between a translated version of these Terms and the English version, the English version will control to the extent permitted by applicable law.
22. Miscellaneous
The Agreement (together with any other terms we provide that apply to any specific Service) constitutes the entire agreement between MaGNaM and you concerning our Services. If any part of the Agreement is unlawful, void, or unenforceable, that part is severable from the Agreement, and does not affect the validity of the remaining provisions to the extent permitted by law. A waiver by either party of any term or condition of the Agreement or any breach thereof will not waive that term or condition or any subsequent breach thereof.
MaGNaM may assign its rights under the Agreement where permitted by law. You may only assign your rights under the Agreement with our prior written consent, unless applicable law provides otherwise.
